Designing for the Unknown Event: Legal Assessment of the need to design for climate change and other unexpected hazards

The interactive session will be presented by a seasoned attorney who will discuss the standard of care as it applies to the need for architects to design for climate change, safety risks and other unexpected hazards.  We will explore recent case law on the topic.  Further, attendees will learn about ways to clarify scope, minimize risk and set reasonable client expectations in terms of designing for unforeseeable events.

Learning Objectives:

1. Participants will learn about the standards required to be considered in designing to accommodate for climate change, safety risks and other relatively unforeseeable risks.

2. Participants will learn techniques to use to clarify their scope of services and educate their clients about climate, safety and other potentially changing conditions.

3. Participants will learn of recent examples in which architects recognized and handled risky projects in which there were climate, safety and other hazardous risks.

4. Participants will learn about the recent court cases that have addressed the need to design for increased safety given the potential for criminal activity.

MICHELE L. GAMBLE, ESQ.

Michele L. Gamble is a trial attorney in the firms San Diego and Orange County offices, having served as partner at the firm since 2006. Her practice focuses on general civil litigation, business litigation, property rights litigation, contract negotiation, professional liability defense, and construction law with an emphasis on risk management and representation of design professionals. Ms. Gamble has represented both public and private entities in civil litigation matters involving wrongful death, property damage, serious personal injury, and allegations of breach of contract, negligence, copyright infringement and intentional misconduct. She has also successfully litigated Not for Profit Directors & Officers claims. She has resolved hundreds of cases through mediation, arbitration, and both bench and jury trials, having obtained multiple unanimous jury verdicts for clients.

Ms. Gamble has authored numerous legal articles and regularly gives presentations to clients and the professional organizations with which she is associated on a wide variety of topics, including work-life balance, professional womens issues, litigation case studies, risk management, profit planning, indemnity, contract negotiation, and copyright infringement. In 2008, Ms. Gamble received a Presidential Citation from the American Institute of Architects (AIA) for service to the architectural profession. She has been repeatedly recognized by Super Lawyers Magazine based on peer recognition and professional achievement and has achieved a Martindale-Hubbell AV Preeminent Peer Review Rating which is held by less than 10% of attorneys and is awarded to only those lawyers with the highest ethical standards and professional ability in the nation. She has a reported appellate decision, Delon Hampton & Associates, Chtd. V. Superior Court, 227 Cal.App.4th 250 (2014) in which the Second District Appellate Court issued a reported decision in favor of Ms. Gambles design professional-client relative to the patent defect statute of limitations.

Ms. Gamble received her Bachelor of Science in Political Science from Santa Clara University in 1994 and her Juris Doctor from University of San Diego School of Law in 1997.

NICOLETTE R. HOEKSTR, ESQ.

Nicolette R. Hoekstra is an associate and trial attorney at Collins Collins Muir + Stewart LLP. Her practice primarily focuses on general civil litigation, business litigation, and professional liability. Nicolette has represented both public and private entities in civil litigation matters involving property damage, serious personal injury, and allegations of breach of contract, and negligence.
Nicolette earned a Bachelor of Arts degree in Political Science from Chapman University in 2015 and a Juris Doctor degree from Loyola Law School, Los Angeles in 2018. She is admitted to practice in the State of California, and in the United States District Court, Central District of California.
