The Americans with Disabilities Act (ADA) creates multiple triggers for lawsuits against architects.  Knowing the triggers and scope of such lawsuits may aid architects in avoiding such suits. Attendees will review a broad range of ADA related suits, including the involvement of a Certified access Specialist Program (CASp)  and discuss what to do if you or a client get involved or sued.

Learning Objectives:

1.Identify the types of lawsuits which arise from ADA codes and requirements.

2.Identify ADA related subjects which are subject to controversial interpretation.

3.Develop strategies for reducing Design Professional liability in relation to ADA lawsuit

4.CASp inspectors, new codes, use in construction observation and public permitting process, effect on ADA litigation.

Mr. Cohen has been with CCM+S  since 2006.  Mr. Cohen has experience defending architects sued for ADA issues which range from cases where the ADA issues are minor defects in a long list of other construction defects, to litigation based entirely upon the existence of ADA barriers in new construction.  Mr. Cohen also has experience representing property owners sued by the handicapped seeking to assert rights under Cal. Civil Code § 51, and 42 USC §12100 et seq. to equal treatment in public accommodations.

Laura Williams is an Associate at Collins Collins Muir + Stewart, LLP in Orange, California.  Ms. Williams' legal practice focuses on representing construction professionals in a variety of disputes including construction defect, environmental law, professional liability and contractual liability.  Ms. Williams has represented both public and private entities in civil litigation matters involving property damage, LEED certification, serious personal injury, breach of contract, constitutional rights violations, architectural copyright, negligence and intentional misconduct in business relations. In addition, Ms. Williams works with her clients to improve their professional contracts and business dealings in order to find ways to limit potential risks before they arise.  Ms. Williams is a member of several construction industry organizations, including the American Institute of Architects Orange County, the U.S. Green Building Council  Orange County Chapter, and she has written publications for the online Newsletter published by the Orange County branch of the American Society of Civil Engineers.
